1.2. This Privacy Policy (hereinafter “Policy”) describes how we process your personal data within the “Be The Next Diamond” project and related services.

1.3. Personal data processing is governed by:

  • Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data (GDPR)
  • Act No. 110/2019 Coll., on personal data processing

2. WHAT PRESONAL DATA WE PROCESS

2.1. Identification and contact data:

  • Name and surname
  • Date of birth
  • Email
  • Phone number
  • Address (if required for specific service)
  • Telegram username

2.2. Payment data:

  • Payment information is processed through Stripe payment gateway
  • We do not store complete credit card numbers
  • We store information about completed transactions (date, amount, type of service)

2.3. Service usage data:

  • Conversation history with DiamondCoach Pro (encrypted)
  • Registration and service activation date
  • Number of messages used
  • Settings preferences

2.4. Tryout and camp participant data:

  • Health data relevant for safe participation (allergies, chronic diseases, regular medication)
  • Copy of travel document (for tryouts)
  • Legal guardian’s contact details (for minors)
  • Photos and video recordings taken during the program

2.5. Technical data:

  • IP address
  • Device type and browser
  • Cookies (see section 8)

3. PURPOSE AND LEGAL BASIC OF PROCESSING

3.1. Service provision (legal basis: contract performance, Art. 6(1)(b) GDPR)

  • Activation and operation of DiamondCoach Pro
  • Organization and implementation of tryouts and camps
  • Communication related to service provision

3.2. Invoicing and accounting (legal basis: legal obligation, Art. 6(1)(c) GDPR)

  • Issuing invoices
  • Maintaining accounting records
  • Archiving accounting documents

3.3. Marketing communication (legal basis: consent, Art. 6(1)(a) GDPR)

  • Sending newsletters
  • Information about new services and products
  • Special offers and promotions
  • This consent can be withdrawn at any time

3.4. Service improvement (legal basis: legitimate interest, Art. 6(1)(f) GDPR)

  • Analysis of service usage
  • Development of new features
  • Improvement of user experience

3.5. Protection of health and safety of participants (legal basis: vital interests, Art. 6(1)(d) GDPR)

  • Processing health data to ensure safe participation in tryouts and camps

3.6. Marketing use of photos and videos (legal basis: consent, Art. 6(1)(a) GDPR)

  • Taking and publishing visual recordings from tryouts and camps
  • This consent can be withdrawn at any time

  • Purpose: Website analytics (Google Analytics), storage (Google Drive)
  • Location: USA (with appropriate GDPR safeguards)

4.2. We have data processingagreements with all processors ensuring an appropriate level of protection for your data.

5. DATA RETENTION PERIOD

5.1. Service provision data:

  • During the contractual relationship
  • After service termination: 3 months for potential complaints

5.2. Accounting documents:

  • 10 years from the end of the tax period (according to accounting law)

5.3. Marketing communication:

  • Until consent withdrawal or subscription termination + 2 years

5.4. DiamondCoach Pro chat history:

  • During active subscription + 6 months after termination
  • Subsequently anonymized or deleted

5.5. Event photos and videos:

  • Until consent withdrawal or maximum 5 years from creation

5.6. Tryout/camp participant health data:

  • Only during the event + 30 days
  • Subsequently securely destroyed

6. YOUR RIGHTS

6.1. Right of access (Art. 15 GDPR)

  • You have the right to obtain confirmation whether we process your personal data
  • You have the right to obtain a copy of processed data

6.2. Right to rectification (Art. 16 GDPR)

  • You have the right to rectification of inaccurate personal data
  • You have the right to complete incomplete data

6.3. Right to erasure (“right to be forgotten”) (Art. 17 GDPR)

  • You have the right to request erasure of personal data
  • This right is limited in cases where we have a legal obligation to retain data

6.4. Right to restriction of processing (Art. 18 GDPR)

  • You have the right to request restriction of processing under certain conditions

6.5. Right to data portability (Art. 20 GDPR)

  • You have the right to receive your data in a structured, commonly used, and machine-readable format
  • You have the right to transmit this data to another controller

6.6. Right to object (Art. 21 GDPR)

  • You have the right to object to the processing of your personal data
  • Especially against processing for direct marketing purposes

6.7. Right to withdraw consent (Art. 7(3) GDPR)

  • If processing is based on consent, you have the right to withdraw this consent at any time
  • Withdrawal does not affect the lawfulness of processing before withdrawal

7. PERSONAL DATA SECURITY

7.1. Technical measures:

  • Communication encryption (SSL/TLS certificates)
  • Encryption of chat history in DiamondCoach Pro
  • Regular security system updates
  • Secured servers in the EU

7.2. Organizational measures:

  • Only authorized persons have access to personal data
  • Confidentiality agreements with employees and processors
  • Regular employee training on personal data protection
  • Regular security audits

7.3. Backups:

  • Regular data backups
  • Secured backup storage

7.4. Security breach procedure:

  • In case of personal data security breach, we will inform you within 72 hours
  • We will also notify the Office for Personal Data Protection

8. COOKIES AND TRACKING TECHNOLOGIES

8.1. What are cookies:

Cookies are small text files stored in your browser when visiting a website.

Necessary cookies:

9. DATA TRANSFER TO THIRD COUNTRIES

9.1. Some of our processors are located outside the European Union (e.g., Stripe in the USA, Telegram in the UAE).

9.2. In these cases, we ensure an appropriate level of protection through:

  • Standard contractual clauses approved by the European Commission
  • Privacy Shield certifications (if available)
  • Other legal mechanisms according to GDPR

10. AUTOMATED DECISION-MAKING AND PROFILING

10.1. DiamondCoach Pro uses AI technology to provide personalized advice and recommendations.

10.2. This processing is not automated decision-making within the meaning of Art. 22 GDPR that would have legal effects or significantly affect you.

10.3. All important decisions (e.g., about tryout acceptance) are made by humans, not automatically.

11. PROTECTION OF MINORS

11.1. “Be The Next Diamond” services can be used by minors with legal guardian consent.

11.2. Processing personal data of minors under 15 years requires legal guardian consent.

11.3. Minors aged 15-18 can give consent themselves, but we recommend involving the legal guardian.

11.4. If we discover that we have inadvertently obtained personal data from a child without appropriate consent, we will delete this data.

12. CHANGES TO PRIVACY POLICY

12.1. We may update this Policy from time to time.

12.2. We will inform you about substantial changes via email or website notification.
