1. INTRODUCTORY PROVISIONS

1.1. These Terms and Conditions govern the relationship between the provider of services and products of the “Be The Next Diamond” project and the user/customer.

The company is not a VAT payer.

1.3. The “Be The Next Diamond” project includes the following services and products:

  • DiamondCoach Pro – AI assistant for sports development
  • Be The Next Diamond Tryouts – sports tryouts in Europe and other locations
  • Be The Next Diamond Camps – sports camps and training sessions
  • Additional services and products according to current offer on the website

1.4. These Terms and Conditions are governed by the laws of the Czech Republic.

1.5. The provider reserves the right to modify and update these Terms and Conditions. The current version is always available at https://bethenextdiamond.com

2. DIAMONDCOACH PRO – SERVICE DESCRIPTION

2.1. DiamondCoach Pro provides:

  • Individual consultations and advice in sports development
  • Mentoring support for players, coaches, and parents
  • Training methodologies and tactical concepts
  • Mental preparation and support
  • Advice on nutrition, recovery, and injury prevention
  • Support in dual career (sports + education)

2.2. The service is provided through AI technology on the Telegram platform, available 24/7.

2.3. Communication takes place in the language preferred by the user.

3. DIAMONDCOACH PRO – TARIFFS AND PAYMENT CONDITIONS

3.1. DiamondCoach Pro offers the following tariffs:

TRIAL OFFER (time-limited):

  • 50 messages
  • Price: 9.90 EUR / 9.90 USD (one-time payment)
  • Validity: 30 days from activation
  • Available only through special promotional campaigns

TALENT (250 messages per month):

  • Monthly: 29.90 EUR / 32.90 USD
  • Quarterly: 26.90 EUR/month / 29.90 USD/month (total 80.70 EUR / 89.70 USD)
  • Annual: 19.90 EUR/month / 21.90 USD/month (total 238.80 EUR / 262.80 USD)

PROFESSIONAL (500 messages per month):

  • Monthly: 49.90 EUR / 54.90 USD
  • Quarterly: 44.90 EUR/month / 49.90 USD/month (total 134.70 EUR / 149.70 USD)
  • Annual: 34.90 EUR/month / 38.90 USD/month (total 418.80 EUR / 466.80 USD)

DIAMOND (1000 messages per month):

  • Monthly: 89.90 EUR / 87.90 USD
  • Quarterly: 71.90 EUR/month / 78.90 USD/month (total 215.70 EUR / 236.70 USD)
  • Annual: 54.90 EUR/month / 59.90 USD/month (total 658.80 EUR / 718.80 USD)

Extra message packages (only for active subscribers):

  • SILVER: 100 messages – 14.90 EUR / 16.90 USD (no expiration)
  • GOLD: 250 messages – 29.90 EUR / 32.90 USD (no expiration)
  • PLATINUM: 500 messages – 49.90 EUR / 54.90 USD (no expiration)

3.2. Plíšek Sport Education s.r.o. is not a VAT payer, therefore prices do not include VAT.

3.3. Payment is processed through Stripe payment gateway.

3.4. Messages are counted in both directions (message from user + response from DiamondCoach Pro = 2 messages).

3.5. For annual and quarterly tariffs, the monthly message limit renews every month on the same day the subscription was activated.

3.6. Unused messages from the monthly limit do not carry over to the next month.

3.7. Extra message packages have no time limit and unused messages remain available even after subscription ends.

4. DIAMONDCOACH PRO – ACTIVATION AND TERMINATION

4.1. After successful payment, the user receives an activation link to the email used during checkout.

4.2. The service is activated by clicking the activation link and starting a conversation in the Telegram app.

4.3. Subscription can be canceled at any time using the /stop command in Telegram chat with DiamondCoach Pro or by canceling recurring payment in Stripe.

4.4. Upon cancellation, the user loses access to unused messages from the monthly limit. Refund for unused messages is not possible.

4.5. Extra message packages purchased before cancellation remain available after cancellation.

4.6. The provider reserves the right to terminate service to users who violate these Terms and Conditions or misuse the service.

5. BE THE NEXT DIAMOND TRYOUTS

5.1. Tryouts are sports trials for talented athletes of various age categories and sports disciplines (football, hockey, other sports according to current offer).

5.2. Program duration:

  • 7-day program
  • 14-day program
  • Individually agreed program

5.3. The program includes (depending on chosen package):

  • Diagnostics and adaptation
  • Training with clubs or professional teams
  • Detailed athlete evaluation
  • Recommendations for further development
  • Possibly other services specified in specific offer

5.4. Tryout price is determined individually according to current offer and includes services specified in the specific offer.

5.6. Participation in tryouts is conditional upon:

  • Proper registration and payment of participation fee
  • Signed informed consent from legal guardian (for minors)
  • Valid travel and health insurance
  • Medical fitness for sports activity (doctor’s certificate may be required)

5.7. The provider reserves the right to refuse a participant for capacity or other legitimate reasons with refund of paid fee.

5.8. In case of tryout cancellation by the provider for reasons on their side, the participant is entitled to a 100% refund of the paid fee.

5.9. In case of cancellation by the participant, the following cancellation policy applies:

  • Up to 30 days before start: 80% refund
  • 29-15 days before start: 50% refund
  • 14-7 days before start: 25% refund
  • Less than 7 days before start: no refund

6. BE THE NEXT DIAMOND CAMPS

6.1. Be The Next Diamond Camps are sports camps and training sessions for various age categories and sports disciplines (football, hockey, other sports according to current offer).

6.2. Price, duration, location, program, and sports focus of the camp are specified in the specific offer.

6.3. Registration is done through the website https://bethenextdiamond.com

6.4. Participation in the camp is conditional upon:

  • Proper registration and payment of participation fee
  • Signed informed consent from legal guardian (for minors)
  • Medical fitness for sports activity

6.5. Cancellation policy follows the specific camp offer or standard conditions stated in article 5.9.

7. DISCOUNTS AND BONUSES

7.1. Holders of active DiamondCoach Pro subscription are entitled to discounts on other “Be The Next Diamond” products and services as follows:

TALENT tariff:

  • 5% discount on full access to XPS library
  • 10% discount on Be The Next Diamond Camps
  • 5% discount on Be The Next Diamond Tryouts

PROFESSIONAL tariff:

  • 10% discount on full XPS library access
  • 15% on Be The Next Diamond Camps
  • 10% on Be The Next Diamond Tryouts

DIAMOND tariff:

  • 15% discount on full XPS library access
  • 20% on Be The Next Diamond Camps
  • 15% on Be The Next Diamond Tryouts

8. INTELLECTUAL PROPERTY

8.1. All content, methodologies and materials provided through Be The Next Diamond services are intellectual property of the provider.

8.2. Users may not copy, distribute, publish or commercially use the content without written consent from the provider.

8.3. Violation may lead to immediate service termination and legal action.

9. LIMITATION OF LIABILITY

9.1. DiamondCoach Pro serves as a supportive tool. It does not provide medical diagnoses or treatment advice. In case of health issues, consult a doctor or physiotherapist.

9.2. The provider is not liable for damages arising from use of the service contrary to these Terms. The provider does not guarantee uninterrupted service availability.

10. COMPLAINTS AND WITHDRAWAL

10.1. Consumers may withdraw from the contract within 14 days. Complaints are submitted in writing to info@bethenextdiamond.com.

10.2. The provider will resolve complaints within 30 days. Refunds are processed within 14 days of complaint approval.

11. PERSONAL DATA PROTECTION

11.1. The provider processes personal data in accordance with GDPR. Details are available in the Privacy Policy at bethenextdiamond.com/…icy.

11.2. Violation of intellectual property rights may lead to immediate service termination and legal action.

12. COMMUNICATION AND NOTIFICATIONS

12.1. All communication between the provider and user takes place through:

  • Email provided during registration
  • Messages in Telegram app (for DiamondCoach Pro)
  • Notifications on the website https://bethenextdiamond.com

12.2. The user is obliged to maintain current contact information.

12.3. Notifications sent to email or via Telegram are considered delivered at the moment of sending.

13. CHANGES TO TERMS AND CONDITIONS

13.1. The provider reserves the right to change and update these Terms and Conditions.

13.2. Users will be informed about substantial changes via email or Telegram message at least 14 days before they take effect.

13.3. The current version of Terms and Conditions is always available at https://bethenextdiamond.com

13.4. By continuing to use the service after changes to the Terms, the user expresses consent to the new Terms.

13.5. If the user does not agree with the changes to the Terms, they have the right to terminate the service before the changes take effect.

14. OUT-OF-COURT DISPUTE RESOLUTION

14.1. In case of a dispute between the provider and consumer, the consumer has the right to turn to an out-of-court consumer dispute resolution body:

14.2. The consumer can also use the European Commission’s Online Dispute Resolution (ODR) platform available at: https://ec.europa.eu/consumers/odr

15. DISPUTE RESOLUTION AND APPLICABLE LAW

15.1. These Terms and Conditions and all relationships arising from them are governed by the laws of the Czech Republic.

15.2. Any disputes will primarily be resolved amicably.

15.3. If no agreement is reached, disputes between the provider and consumer are resolved by the competent court in the Czech Republic according to the consumer’s place of residence.

15.4. Disputes between the provider and entrepreneur are resolved by the materially and locally competent court in the Czech Republic.

16. SPECIAL PROVISIONS FOR MINOR PARTICIPANTS

16.1. Participation of minors in tryouts and camps is conditional upon written consent from a legal guardian.

16.2. The legal guardian is obliged to provide the provider with:

  • Emergency contact information
  • Information about the child’s health status (allergies, chronic diseases, regular medication)
  • Copy of valid travel document (for tryouts)
  • Copy of health insurance

16.3. The legal guardian acknowledges that during the program, photographs and video recordings may be taken for marketing purposes of the “Be The Next Diamond” project.

16.4. If the legal guardian does not consent to taking and publishing visual recordings of their child, they are obliged to notify the provider in writing before the program begins.

17. FINAL PROVISIONS

17.1. These Terms and Conditions become effective on February 19, 2026.

17.2. By submitting an order and making a payment, the user confirms that:

  • They have read these Terms and Conditions
  • They understand and agree with them
  • They are over 18 years old or have legal guardian consent (for minors)

17.3. If any provision of these Terms and Conditions is invalid or ineffective, the remaining provisions remain valid and effective.
